TO WHOM IT MAY CONCERN:

PURSUANT TO THE TEXAS OPEN MEETINGS ACT, NOTICE IS HEREBY GIVEN THAT A SPECIAL MEETING OF THE COMMISSIONERS' COURT OF PANOLA COUNTY, TEXAS WILL BE HELD ON THE 25TH DAY OF FEBRUARY, 2008, IN THE COMMISSIONERS' COURTROOM IN THE PANOLA COUNTY COURTHOUSE IN CARTHAGE, TEXAS AT 9:00 O'CLOCK A.M. AT WHICH MEETING THE FOLLOWING SUBJECTS WILL BE DISCUSSED AND THE FOLLOWING MATTERS ACTED UPON:

OPEN MEETING:

1. CITIZEN COMMENTS: This is for citizens to comment on any subject not on the current agenda concerning county business. Members of the Court may answer direct questions, but any action from this item must be scheduled on a future agenda.

2. COMMISSIONERS' REPORT: These are for informational purposes only. Any action that needs to be taken on the basis of these reports will be placed on a future agenda for action.

3. COUNTY JUDGE'S REPORT: This is for informational purposes only. Any action that needs to be taken on the basis of this report will be placed on a future agenda for action.

4. CONSENT ITEMS:

PERSONNEL

a. To record an increase in salary of $0.50 per hour for Deputy Tax Assessor-Collector Shaladrian Jones effective February 25, 2008.

ROAD & BRIDGE

a. To approve and record a request by Sendero Energy, Inc. to cross under Panola County Road #326 with a 4" line.

MISCELLANEOUS

a. To record American States Insurance Company Continuation Certificate for Panola County Sheriff's Department Reserve Deputy John Lee Wright, Jr.

b. To record letter from U. S. Department of Justice approving the polling place change from Woods Community Center to Woods Volunteer Fire Department.

c. To record Annual Audit of Proceeds of Criminal Asset Forfeitures for the Panola County Sheriff's Department for Fiscal Year ending December 31, 2007.

d. To record Annual Audit of Proceeds of Criminal Asset Forfeitures for Panola County Constable Precinct #1 and #4 for Fiscal Year ending December 31, 2007.

e. To record Annual Audit of Proceeds of Criminal Asset Forfeitures for Panola County Constable Precinct #2 and #3 for Fiscal Year ending December 31, 2007.

REQUESTS FOR CONFERENCE ATTENDANCE

a. To approve and record a Request for Attendance at a Conference for the following Panola County elected official(s)/employee(s): Veterans Service Officer James G. Young; and Panola County Extension Agent-AG/NR Douglas L. McKinney (2).

5. To approve Road & Bridge requisitions and to approve payment of current Panola County bills as presented on vouchers prepared and submitted by the County Auditor.

6. Lester Bellows to address Commissioners' Court regarding public access to Judicial Records governed by Rule 12 of the Rules of Judicial Administration.

7. To open sealed proposals for Data Processing Systems used for Financial Management, Law Enforcement, Judicial, Court Administration and for the offices of County Clerk, District Clerk, and District Attorney.

8. To receive report from County Clerk on status of Panola County Salary Grievance Committee for 2008, including acceptance or rejection of nominees previously selected by Commissioners' Court.

9. To select and appoint any additional members required for the Panola County Salary Grievance Committee for Fiscal Year 2008 and to authorize the County Clerk to notify such additional appointees, secure approval or disapproval of such appointment and to report the same to the Commissioners' Court at its March 10, 2008 meeting as required by Local Government Code, Section 152.015, V.T.C.A.

10. To reappoint Pastor Dale Reed, Ms. Phala Smith, Ms. Fatha Burchette, Dr. David Proctor, and Reverend Mervyn Scott to the Sexually Oriented Business Order, Permit and License Appeal Board for a one year term commencing February 28, 2008 and ending February 28, 2009.

11. To discuss and act upon amending the method used to determine invoice pricing as required by our current agreement for gasoline and diesel purchases for the Road and Bridge Department; and to authorize the use of the closing rack price on day of pick up from refinery as per the Oil Pricing Information Service (OPIS) verification report plus markup and various taxes and fees.

12. To discuss and act upon issuing an Order of Special Election calling for an election to determine whether to legalize the sale of mixed beverages in restaurants by food and beverage certificate holders only in the City of Carthage; and whether to legalize the sale of beer and wine in the City of Carthage for off-premise consumption only.

13. To discuss and act upon approving an Engagement Agreement between Panola County and G. P. Monnin Consulting, Inc. for services rendered with regards to the actuarial study related to Post Employment Health benefits.

14. To discuss and act upon appointing retired Justice of the Peace Pat Davis to set on the bench in Justice Court in the absence of Elected Judges.

15. To discuss and act upon approving a Sales Order between Panola County and ACS for three (3) new public workstations for the County Clerk's Office.

16. To discuss and act upon adopting Resolution #2008-02 in support of 123rd Judicial District Adult Drug Court Grant Application #1747005; to approve submission of 123rd Judicial District Adult Drug Court Application; and to approve Cooperative Working Agreements between Panola County and 123rd Judicial District Community Supervision and Corrections Department (CSCD) and Shelby County for 123rd Judicial District Adult Drug Court for Fiscal Year 2009.
